1 introduction

1.1 These rules (the Rules) set out the terms of use for the discussion forums made available via the engagewithyou website (the Forums) and apply to all users.  Any submission of material by you to the Forums means that you accept and agree to abide by these Rules.

1.2 These Rules supplement our privacy policy.

1.3 The Forums are made available by Engage Mutual Services Limited a non-regulated wholly owned subsidiary of Homeowners Friendly Society Limited which is registered and incorporated under the Friendly Societies Act 1992 (registered number 964F) and authorised and regulated by the Financial Services Authority under register number is 110072. You can check this on the FSA's Register by visiting the FSA's website or by contacting the FSA on 0845 606 1234.

2 no moderation

2.1 The Forums are not moderated and we will not be responsible as author, editor or publisher of any contribution submitted to the Forums and we expressly exclude our liability for any loss or damage arising from the use of the Forums by any person in contravention of these Rules.  We reserve the right to promptly remove, or to disable access to, any contribution which we deem to be potentially defamatory of any person, unlawful or in violation of any third party rights.

3 submission of contributions

3.1 To add a contribution to a Forum or start a new thread for discussion please register and follow the instructions. 

4 content standards

4.1 These content standards apply to each part of a contribution as well as to it as a whole.  The content standards must be complied with in spirit as well as to the letter.  We will be entitled to determine, at our discretion, whether a contribution breaches these content standards.

4.2 Each contribution which you make must:

(a) be accurate (where it states facts);

(b) be genuinely held (where it states opinions or beliefs);

(c) comply with the law applicable in England and Wales and in any country from which it is posted; and

(d)  be relevant.

4.3 Each contribution which you make must not:

(a) be defamatory of any person;

(b) be obscene, offensive, hateful or inflammatory;

(c) promote discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;

(d) disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual;

(e) infringe any copyright, database right or trade mark of any other person;

(f) breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

(g) be in contempt of court;

(h) be likely to harass, upset, embarrass, alarm or annoy any other person;

(i) impersonate any person, or misrepresent your identity or affiliation with any person;

(j) give the impression that the contribution emanates from us if this is not the case;

(k) advocate, promote, incite any third party to commit, or assist any unlawful or criminal act;

(l) contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; and/or

(m) contain any advertising or promote any services or web links to other sites.

5 copyright

5.1 By submitting a contribution to any Forum you agree to grant us a non-exclusive licence to use that contribution.  Although you will still own the copyright in your contribution, we will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your contribution.  This licence will be free of charge, perpetual and capable of sub-licence.  We  may exercise all copyright and publicity rights in the material contained in your contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.

5.2 Please also note that in accordance with the content standards as detailed above you must ensure that your contribution does not infringe any copyright, database right or trade mark of any other person.  By submitting your contribution to any Forum  you are warranting that you have the right to grant us the non-exclusive copyright licence described above.

5.3 If you are not in a position to grant such a licence to us then please do not submit the contribution in question to any Forum.

6 breach of these rules

6.1 When we consider that a breach of the content standards as detailed above has occurred, we may at our discretion take such action as we deem appropriate.  Failure to comply with these Rules constitutes a material breach of the terms of use on which you are permitted to use the Forums and may result in our taking all or any of the following actions:

(a) immediate, temporary or permanent withdrawal of your right to use the Forums;

(b) immediate, temporary or permanent removal of any contribution already posted on any Forum by you;

(c) issue of a warning to you;

(d) legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

(e) further legal action against you; and

(f) disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

6.2 We exclude our liability for all action we may take in response to breaches of these Rules.  The actions described above are not limited, and we may take any other action we reasonably deem appropriate.

7 complaints

7.1 If you wish to complain about any contribution posted to any Forum, please contact us by clicking the 'report' button next to the contribution.  We will then review the contribution and decide whether it complies with our content standards as detailed above.  We will deal with any contribution which, in our opinion, violates our content standards as described above (see section "Breach of these Rules"). 

8 changes to these rules

8.1 We may revise these Rules at any time.  You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
